COLUMBUS, Ohio (AP) A justice on the Ohio Supreme Court was charged with driving under the influence after several people reported a motorist driving erratically.
Justice Alice Robie Resnick failed field sobriety tests Monday, Highway Patrol Lt. Rick Zwayer said Tuesday. Zwayer said ``a strong odor of alcohol was detected'' on the 65-year-old justice.
Her driver's license was automatically suspended because she refused to take a blood-alcohol content test, he said.
Driving under the influence can result in a penalty of three days to six months in jail, a fine of $250 to $1,000 and license suspension of up to three years.
Court officials said there is no automatic disciplinary action for a judge charged with driving under the influence.
Resnick did not return a call seeking comment.
The former prosecutor has voted in a handful of decisions involving drunken driving cases. In 1996, she wrote the majority opinion in a case that said police do not have to tell drunken driving suspects that they have the right to a second, independent blood alcohol test.
